Terms and Conditions

The terms that govern your use of this website and your relationship with Brazelia MedSpa & Integrative Wellness as a patient, member or visitor.

Please read section 33 carefully. It requires most disputes to be resolved by individual binding arbitration rather than in court, and waives your right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days — section 33.6 explains how.

1. Acceptance of These Terms

These Terms and Conditions are an agreement between you and Brazelia MedSpa & Integrative Wellness. They apply when you visit brazeliamedspa.com, submit a form, book an appointment, enrol in a membership or program, or receive services from us.

By using this website or receiving services from us, you agree to these Terms. If you do not agree, do not use the website and do not book with us.

2. Who We Are

Brazelia MedSpa & Integrative Wellness is a physician-led integrative medical and aesthetic practice at 101 Plaza Real South, Suite G, Boca Raton, Florida 33432, telephone 561.353.2265.

Our Medical Director is Herbert R. Slavin, M.D. Medical services are provided by licensed physicians and by advanced practice registered nurses working under a written physician protocol, within the scope of their Florida licences. Aesthetic and skin services are provided by licensed medical estheticians and licensed electrologists as Florida law permits. Dr. Brazelia Lazzari is our Founder and Clinical Director and is licensed in Florida in Oriental Medicine and Acupuncture; she is not a medical doctor and does not hold a licence under Florida Statutes chapter 458 or 459.

3. Changes to These Terms

We may update these Terms. The current version is always posted here with its effective date. If we make a material change, we will post notice on this website and, where we hold your email address and the change materially affects an ongoing membership or program, we will email you before the change takes effect. Your continued use of the website or services after the effective date means you accept the updated Terms. If you do not accept them, stop using the website and contact us to end any membership.

4. Eligibility and Age

You must be at least 18 years old to use this website, to book an appointment, and to enrol in any membership or program.

Our medical services — including prescription therapy, weight-loss medication, hormone therapy, peptide therapy, IV therapy and regenerative treatments — are provided only to patients 18 and older. Certain aesthetic services may be provided to a patient under 18 only where clinically appropriate, only in person, and only with the documented consent of a parent or legal guardian who attends the appointment. We may require proof of age and identity at any time.

5. No Provider-Patient Relationship Through This Website

Using this website does not make you our patient. Reading this site, submitting the contact form, chatting with us online, requesting an appointment, or receiving general information from us does not create a physician-patient, provider-patient, or any other treatment relationship.

A treatment relationship begins only after you have attended a consultation, we have taken a history and performed an appropriate evaluation, and a licensed provider has accepted you for care.

6. Information Only, Not Medical Advice

Everything on this website — service descriptions, program pages, the journal and blog, FAQs, timelines, statistics and comparisons — is general information for educational purposes. It is not medical advice, a diagnosis, a treatment recommendation, or a substitute for consultation with a qualified health care professional who has examined you.

Never disregard professional medical advice, or delay seeking it, because of something you read here. Always consult your own physician before starting, stopping or changing any treatment, medication or supplement.

Where this website references published clinical studies, those results describe the populations studied under the conditions of those trials. They are not a prediction, promise or representation of what you will experience.

7. Medical Emergencies

If you think you may have a medical emergency, call 911 immediately or go to the nearest emergency department. Do not use this website, our contact form, our live chat, email or text message to report an emergency or an urgent medical concern. These channels are not monitored continuously and are not secure.

8. Individual Results Vary

We do not guarantee any particular result from any treatment, program or membership, and nothing on this website should be read as a guarantee.

Outcomes differ from person to person and depend on factors including your age, sex, genetics, baseline health and body composition, pre-existing medical conditions, hormone and metabolic status, current medications, skin type and quality, healing response, nutrition, sleep, alcohol use, physical activity, adherence to the plan prescribed, the number and timing of treatments completed, and how you care for yourself afterwards.

Some patients experience substantial improvement. Some experience modest improvement. Some patients do not respond to a given treatment at all, and some are not candidates for it. Any images, testimonials, timelines or figures shown on this website reflect the experience of a particular individual or of a study population and are not typical, expected or promised outcomes for you. Your provider will discuss realistic expectations with you at consultation.

9. Consultation, Candidacy and Our Right to Decline

A consultation is required before any medical treatment. Treatment is approved on an individual basis after evaluation, and may require laboratory testing, a medical history, a physical assessment, and review of your current medications.

We reserve the right to decline, postpone, modify or discontinue any treatment, membership or program at any time where in our clinical judgment it is not appropriate, not safe, or not in your interest, or where you decline recommended monitoring. Requesting or paying for a service does not entitle you to receive it.

Booking an appointment online is a request. An appointment is confirmed only when we confirm it.

10. Florida Advertising Disclosure

Florida Statutes section 456.062 requires the following notice wherever a licensed health care practitioner advertises a free, discounted or reduced-fee service, examination or treatment. It applies to any complimentary consultation, introductory offer, promotional price, package discount or membership discount we offer.

THE PATIENT AND ANY OTHER PERSON RESPONSIBLE FOR PAYMENT HAS A RIGHT TO REFUSE TO PAY, CANCEL PAYMENT, OR BE REIMBURSED FOR PAYMENT FOR ANY OTHER SERVICE, EXAMINATION, OR TREATMENT THAT IS PERFORMED AS A RESULT OF AND WITHIN 72 HOURS OF RESPONDING TO THE ADVERTISEMENT FOR THE FREE, DISCOUNTED FEE, OR REDUCED FEE SERVICE, EXAMINATION, OR TREATMENT.

Prices quoted on this website or in any advertisement are subject to the variables described at consultation, including the treatment plan you and your provider agree on, the number of units or sessions required, the medication and dosing prescribed, and any laboratory testing needed. Final pricing is confirmed with you before treatment.

11. Regulatory Status of Certain Treatments

We believe you are entitled to know the regulatory status of what we offer, stated plainly. Your provider will go through all of this with you at consultation, along with the risks, benefits and alternatives, before you consent to any treatment.

11.1 Prescription medications

Prescription medications are prescribed only after evaluation, only where clinically appropriate, and only by a provider with prescribing authority. Approved medications carry FDA-approved labelling, which your provider will review with you.

11.2 Compounded medications

Compounded medications are not FDA-approved. The FDA does not review compounded preparations for safety, effectiveness or manufacturing quality, and their potency and purity are not verified by the FDA. Compounded preparations are prepared by a licensed compounding pharmacy or outsourcing facility pursuant to an individual prescription, and are used only where a provider determines that an FDA-approved product is not clinically appropriate for that particular patient and documents the reason.

Federal restrictions on compounding certain medications change over time, including for GLP-1 and GIP/GLP-1 medications. We do not offer any compounded medication as a routine or lower-cost substitute for an available FDA-approved product. What is available to you will be determined by your clinical circumstances and by the law in effect at the time.

11.3 Peptide therapy

Peptide therapies are not FDA-approved for the uses commonly discussed in wellness and longevity medicine, and the FDA has not evaluated them for safety or effectiveness for those uses. The regulatory status of individual peptides differs, and several peptides widely marketed elsewhere may not lawfully be compounded in the United States.

Any peptide protocol is prescribed on an individualized basis within a provider-patient relationship after evaluation. We make no claim that peptide therapy will heal an injury, reverse aging, extend lifespan, build muscle, cause weight loss, or treat, cure or prevent any disease or condition. Your provider will tell you what is known, what is not known, and what is not available.

11.4 Regenerative and biologic therapies

Regenerative and biologic treatments discussed on this website are not FDA-approved, and the FDA has not evaluated them for safety or effectiveness for the uses discussed. This includes exosome preparations, and any cell- or tissue-derived product other than a patient’s own platelet-rich plasma or platelet-rich fibrin prepared and reintroduced during the same procedure.

We make no claim that any regenerative or biologic treatment will treat, cure, reverse, repair or prevent any disease, injury or condition, including arthritis, joint disease, neuropathy, hair loss, sexual dysfunction, autoimmune disease or any neurological or developmental condition. Availability is subject to the law in effect at the time, and your provider will explain the regulatory position and the alternatives.

11.5 Hormone therapy

Hormone therapy, including bioidentical hormone replacement therapy and pellet therapy, requires evaluation, laboratory testing and individualized prescribing, and requires ongoing monitoring. Compounded hormone preparations, including pellets, are not FDA-approved. Hormone therapy carries risks that differ by patient, by hormone and by route of administration, and your provider will review them with you. It is an elective service and is generally not covered by health insurance.

11.6 Devices, lasers and energy-based treatments

Devices used in the practice are operated by trained personnel within the scope of their Florida licences and, where the law requires, under physician supervision or a physician protocol. A device cleared by the FDA is cleared for specific indications; where a provider recommends use for a different purpose, that is an off-label use and your provider will tell you so.

11.7 Nutrient infusions and supplements

IV nutrient infusions, vitamin injections and dietary supplements are not FDA-approved to treat any disease. Statements about supplements on this website have not been evaluated by the Food and Drug Administration, and these products are not intended to diagnose, treat, cure or prevent any disease.

Where we offer a consultation by live video, the following apply.

We do not offer treatment to patients located outside the United States.

13. Not Insurance; Financial Responsibility

A Brazelia membership or program is not health insurance, is not a health plan, is not a discount medical plan organization, and is not a substitute for health insurance. It does not pay for care from any other provider, does not cover hospitalization or emergency care, and does not satisfy any requirement that you carry health coverage. You should maintain your own health insurance.

Our services are elective and are generally paid for directly by you. You are financially responsible for all services you receive. We generally do not bill health insurance for elective aesthetic, wellness, longevity or hormone services. If you wish to seek reimbursement from an insurer, a health savings account or a flexible spending account, you may request a receipt; we cannot and do not guarantee that any service will be eligible or reimbursed, and eligibility is between you and your plan administrator.

Third-party financing, such as CareCredit, is offered by independent companies on their own terms. We are not a lender, we do not set their rates or terms, and we are not responsible for their decisions or their agreements with you.

14. Notice to Medicare and Medicaid Beneficiaries

The elective services offered by Brazelia are not covered by Medicare, Medicaid or any other federal health care program, and we do not submit claims for them to any federal program. If you are a Medicare or Medicaid beneficiary, you are responsible for paying for these services yourself. Any membership discount or promotional pricing is offered on commercially reasonable terms and is not intended, and may not be used, to induce the referral or ordering of any item or service payable by a federal health care program.

15. Pricing and Payment

16. Memberships, Programs and Recurring Billing

Brazelia offers memberships and multi-month programs. This section sets out the rules that apply to all of them. The specific price, billing frequency, minimum term, and the services included in your particular membership or program are set out in the membership agreement you receive and accept at enrolment, which forms part of these Terms. Where that agreement and this section differ, your signed agreement controls for your membership.

16.1 Enrolment and disclosure

Before you enrol and before we collect any payment information, we will disclose to you, clearly and in writing: the amount you will be charged, how often you will be charged, the date of your first and next charges, the minimum term if any, the deadline to cancel to avoid the next charge, and how to cancel. You will be asked to give separate, affirmative consent to recurring billing — it is never bundled into your acceptance of these Terms and is never pre-checked. We will email you a confirmation restating these terms immediately after you enrol.

16.2 Automatic renewal and billing authorization

Memberships renew automatically until you cancel. By enrolling you authorize us to charge your payment method on file, on a recurring basis, for the membership fee and applicable taxes, without further authorization from you, until you cancel. You agree to keep your payment information current, and you authorize us to update card details through account-updater services your card issuer provides.

For any membership or program with an initial term of twelve months or longer, we will send you a written reminder between 30 and 60 days before the deadline to cancel, telling you that it is about to renew and how to cancel.

16.3 How to cancel

Cancelling is always at least as easy as enrolling was. If you enrolled online or by email, you may cancel online or by email — you will never be required to come in, to telephone, or to speak to anyone in order to cancel.

To cancel, email drb@brazeliamedspa.com, telephone 561.353.2265, or tell us in person. We will confirm your cancellation in writing.

16.4 Changes to price

We will give you at least 30 days’ written notice before any increase in your membership fee takes effect. The notice will state the new amount and the date it applies. If you do not want to continue at the new price, you may cancel before it takes effect at no charge and with no penalty.

16.5 Failed payments

If a payment is declined we will contact you and give you at least seven days to update your payment method before we suspend membership benefits. We may re-present a declined charge. We do not charge a late fee. If payment is not resolved, we may suspend or terminate the membership; any banked credits are handled under section 16.7.

16.6 Refunds

Membership and program fees are not refundable except as stated in your agreement or as required by law. Because a membership gives you access and benefits for the period you paid for, cancelling part-way through a period does not produce a refund of that period — but you keep the benefits until it ends. Services that we cancel, that we cannot provide, or that we decline to perform on clinical grounds are refunded or credited in full, at your choice.

Memberships, programs, credits and included services are personal to you and may not be transferred, shared, sold or assigned to another person. You may ask us to pause a membership for a documented medical reason, pregnancy, or extended travel; we will not unreasonably refuse, and we will confirm any pause in writing.

16.9 Suspension and termination by us

We may suspend or terminate a membership for non-payment, for abusive or unsafe conduct toward staff or other patients, for misuse of benefits, or where continued treatment is not clinically appropriate. Where we terminate for a reason other than your conduct, we refund the unused portion of any period you have paid for.

17. Appointments, Deposits, Cancellations and No-Shows

Appointment time is reserved for you, and a missed appointment is time another patient could have used.

Clinical photographs may be taken as part of your medical record to document your baseline and your progress. Those images are part of your protected health information and are handled under our Notice of Privacy Practices.

We will never use your image, likeness, name, voice or testimonial in any advertising, on this website, or on social media without your separate, specific, written authorization — a standalone document, not a checkbox buried in an intake form.

Your treatment will never be conditioned on signing it. You may decline, and it will make no difference to the care you receive.

That authorization will describe exactly which images may be used, where they may appear, for how long, and how to revoke it. You may revoke it at any time in writing. Revocation stops further use going forward; material already printed, published, syndicated or reshared by others cannot always be recalled, and we will tell you honestly what we can and cannot retrieve.

Where images do appear in our marketing, they are of actual patients, used with written authorization, and are not digitally altered to exaggerate a result. Results shown are that individual’s and are not typical or promised. See section 8.

Please do not photograph or record other patients or staff on our premises.

21. Reviews and User Content

We welcome honest reviews, and we welcome critical ones.

22. Electronic Communications

By using this website or giving us your contact details, you consent to receive communications from us electronically — by email, text message and notices posted on this website — and you agree that electronic communications, agreements and notices satisfy any legal requirement that they be in writing. You may withdraw this consent by telling us, and receive communications by post instead.

Remember that email, text and web forms are not secure. See the Privacy Policy.

23. Text Message Terms

If you provide your mobile number and consent, you agree to receive text messages from Brazelia MedSpa & Integrative Wellness at that number. Messages may be sent using automated technology.

24. Acceptable Use of This Website

You may use this website for lawful purposes only. You agree not to: use it in any way that breaks the law; submit false information or impersonate anyone; attempt to gain unauthorized access to any part of the site, its servers or any connected system; introduce malware; scrape, harvest or use automated means to collect data or email addresses; use it to send unsolicited commercial messages; interfere with its operation or with anyone else’s use of it; or reverse engineer any part of it.

We may restrict or terminate your access to the website at any time for a breach of these Terms.

25. Intellectual Property

The content of this website — text, photographs, graphics, video, design, layout, code and compilation — is owned by Brazelia MedSpa & Integrative Wellness or its licensors and is protected by copyright and other laws. “Brazelia,” “Brazelia MedSpa” and our logo are our marks. Third-party names, brands and product marks appearing on this site belong to their respective owners and are used to identify those products; their appearance does not imply any endorsement of us by them.

You may view and print pages of this website for your own personal, non-commercial use. You may not otherwise copy, republish, distribute, modify, frame, sell or create derivative works from any part of it without our prior written permission.

26. Copyright Complaints

If you believe material on this website infringes your copyright, send a written notice to our designated agent at Brazelia MedSpa & Integrative Wellness, 101 Plaza Real South, Suite G, Boca Raton, FL 33432, or drb@brazeliamedspa.com, including: your physical or electronic signature; identification of the work you say is infringed; identification of the material and where it is on our site; your contact details; a statement that you have a good faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We will respond as the Digital Millennium Copyright Act requires.

This website links to third-party sites and embeds third-party services, including online booking, live chat, financing applications, published medical literature and social media. We do not control them, we do not endorse everything on them, and we are not responsible for their content, availability, security or practices. Your use of a third-party service is governed by that provider’s own terms and privacy policy.

28. Assumption of Risk

All medical and aesthetic procedures carry risk. Depending on the treatment, risks may include pain, bruising, swelling, redness, bleeding, infection, allergic or hypersensitivity reaction, scarring, changes in pigmentation, burns, nerve injury, asymmetry, lumps or irregularity, vascular occlusion, blindness in rare cases from injectable treatments, an unsatisfactory cosmetic result, the need for further treatment, and reaction to medication. Some risks are serious and some are permanent.

Your provider will review the specific risks, benefits and alternatives of your treatment with you, and you will give written informed consent, before that treatment is performed. That treatment-specific informed consent governs the treatment itself. By choosing to receive services, you accept the risks disclosed to you in it.

Nothing in these Terms limits any right you have under Florida law with respect to professional negligence, and nothing here is intended to waive any such right.

29. Disclaimer of Warranties

This website and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement, and we do not warrant that the website will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any information on it is complete, accurate or current.

This section applies to the website and its content. It does not disclaim the standard of care owed to you by a licensed health care provider in the course of treatment.

30. Limitation of Liability

To the fullest extent permitted by law, Brazelia MedSpa & Integrative Wellness and its owners, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of this website, whether based in contract, tort, strict liability or otherwise, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to this website and these Terms will not exceed the greater of two hundred dollars or the amount you paid us for services in the twelve months before the event giving rise to the claim.

This section does not apply to, and does not limit, any claim for personal injury arising from the provision of professional health care services, and it does not limit any liability that cannot be limited under Florida or federal law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

31. Indemnification

You agree to indemnify and hold harmless Brazelia MedSpa & Integrative Wellness and its owners, officers, employees, contractors and agents from any claim, loss, liability, damage or expense, including reasonable attorneys’ fees, arising out of your breach of these Terms, your misuse of this website, your violation of any law, or your infringement of anyone’s rights. This does not apply to any claim arising from our own negligence or misconduct.

32. Privacy

Our Privacy Policy and Notice of Privacy Practices and our Cookie Policy are incorporated into these Terms by reference and explain how we handle information about you.

33. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury decide your claim.

33.1 Talk to us first

Most problems can be solved quickly. Before starting arbitration or any legal proceeding, you agree to give us written notice of the dispute at Brazelia MedSpa & Integrative Wellness, 101 Plaza Real South, Suite G, Boca Raton, FL 33432, or drb@brazeliamedspa.com, describing the dispute and the relief you want. We will do the same before starting a proceeding against you. Both sides agree to try in good faith to resolve it informally for 45 days from the date the notice is received. This period is a condition of starting arbitration.

33.2 Agreement to arbitrate

If we cannot resolve it, you and Brazelia agree that any dispute arising out of or relating to these Terms, this website, a membership or program, or our commercial relationship will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration is less formal than a lawsuit; an arbitrator can award the same individual relief a court could, and the arbitrator’s decision is generally final.

33.3 What is not covered

33.4 Individual basis only

You and Brazelia agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding. You and Brazelia waive the right to a trial by jury for any dispute covered by this section. If this class action waiver is held unenforceable as to a claim, that claim will proceed in court and the rest of this section will continue to apply.

33.5 Costs and location

Arbitration will be conducted in Palm Beach County, Florida, or by telephone or video, or by documents only, at your election. We will pay the arbitration filing, administration and arbitrator fees that exceed what it would have cost you to file in court, unless the arbitrator finds your claim frivolous. Each side otherwise bears its own attorneys’ fees unless a statute or the arbitrator provides otherwise.

33.6 Your right to opt out of arbitration

You may opt out of this arbitration agreement. Send written notice within 30 days of the date you first accept these Terms — or, if you are already a patient or member, within 30 days of the effective date at the top of this page — to: Arbitration Opt-Out, Brazelia MedSpa & Integrative Wellness, 101 Plaza Real South, Suite G, Boca Raton, FL 33432, or by email to drb@brazeliamedspa.com with “Arbitration Opt-Out” in the subject line.

Include your name, address and the email or phone number associated with your account. Opting out has no effect on your care, your membership, or anything else. If you opt out, section 34 governs where disputes are heard.

33.7 Time limit

To the extent permitted by law, any claim arising out of or relating to these Terms or this website must be brought within one year after it arises, or it is permanently barred. This does not apply to claims for professional negligence or personal injury, which are governed by the limitation periods in Florida law.

34. Governing Law and Venue

These Terms and any dispute arising from them are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Subject to section 33, you and Brazelia agree that the exclusive venue for any proceeding is the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.

This website is operated from Florida. We make no representation that its content is appropriate or available for use elsewhere, and those who access it from other locations do so on their own initiative and are responsible for compliance with local law.

35. Accessibility

We want everyone to be able to use this website and our practice.

We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA, and we review our site against the more recent WCAG 2.2 criteria as well. We describe our current status as partially conformant, which means parts of the site do not yet fully meet that standard. Known limitations include some third-party components we embed but do not control, such as our online booking tool and live chat widget, and some older images and documents.

What we do: consider accessibility in design and content decisions, review the site periodically using both automated tools and manual testing, and require improvements from our vendors where we can.

Tell us about a barrier. If any part of this website is difficult or impossible for you to use, contact us and we will help you directly and work to fix it.
