Terms & Conditions

These terms govern your use of brazeliamedspa.com. They are not a treatment agreement — the terms of your care are set out in the consent and financial documents you receive in our office.

1. Acceptance of these terms

This website is operated by Brazelia MedSpa & Integrative Wellness (“Brazelia,” “we,” “us,” or “our”). By accessing or using brazeliamedspa.com (the “Site”), you agree to these Terms & Conditions and to our Privacy Policy and Cookie Policy, which are incorporated here by reference. If you do not agree, please do not use the Site.

These terms apply to your use of the Site only. They do not describe the terms of any treatment you receive from us. Treatment terms — including informed consent, treatment-specific risks, scheduling and cancellation policies, payment terms, and any package or plan you purchase — are set out in the documents you review and sign at our office before care begins. Where a signed office document and these terms differ, the signed document controls.

2. Who we are

Brazelia MedSpa & Integrative Wellness is a single-location medical spa and integrative wellness practice in Boca Raton, Florida. Clinical services are provided by licensed professionals practicing within the scope of their Florida licenses and under the supervision arrangements required by Florida law.

3. This site is not medical advice

Everything on the Site — service pages, articles, blog posts, FAQs, downloadable material, and any automated chat — is general educational information. It is not medical advice, diagnosis, or treatment, and it is not a substitute for a consultation with a qualified healthcare professional who has evaluated you personally.

Descriptions of treatments on the Site explain what a service generally involves. They are not a representation that any particular treatment is appropriate, available, or safe for you. Whether a treatment is appropriate for you can only be determined after an individual consultation and evaluation, and some people are not candidates for some services.

4. No provider–patient relationship is created online

Using the Site, reading our content, submitting a contact or booking form, or exchanging messages with us does not create a provider–patient relationship. That relationship begins only when you are seen and accepted as a patient of the practice following an evaluation.

Please do not send detailed personal health information through the Site’s contact forms or chat. Those channels are not intended or secured for clinical communication. If you need to discuss your health history or a clinical concern, call the office.

5. Individual results vary

Any results described on the Site, and any before-and-after images, reflect the experience of specific individuals. They are not a promise, guarantee, or prediction of the results you will obtain. Outcomes vary based on individual factors including anatomy, health history, adherence to a plan, and other variables outside our control. No outcome is guaranteed.

6. Appointment requests

Booking tools and contact forms on the Site submit a request. An appointment is not confirmed until we confirm it with you directly. We may need to reschedule or decline a request — for example, if the service requested is not clinically appropriate for you, or if availability changes.

7. Pricing and availability

Prices, promotions, and service offerings shown on the Site are subject to change and may end or be modified at any time without notice. Pricing shown online is indicative; the price applicable to you is the price quoted to you in writing by the practice. We make reasonable efforts to keep the Site accurate, but we do not warrant that all content is current, complete, or free of error, and we may correct errors at any time.

8. Artificial intelligence in our communications

We use artificial intelligence (AI) assistants to help answer chat messages on the Site and to handle some telephone calls, including calls we place to you. An assistant identifies itself as automated. You can ask for a person at any time, on any channel, and you will get one.

These terms apply to anything an AI assistant does on our behalf.

• It does not give medical advice. Nothing an AI assistant tells you is a diagnosis, a treatment recommendation, or clinical guidance, and nothing it says creates a provider–patient relationship. Sections 3 and 4 apply to it in full.
• It cannot confirm an appointment. A time an assistant offers or writes down is a request, on the same footing as the booking tool described in Section 6. Your appointment is confirmed when we confirm it with you directly.
• It cannot quote a binding price. Any figure it gives you is an estimate and is subject to Section 7. Price and suitability are settled in the office.
• It can be wrong. AI assistants make mistakes, including about availability, pricing, and what we offer. Where what an assistant told you differs from our records or from what our staff tell you, our records and our staff govern.

Do not use chat, text, or an AI assistant for anything urgent. If you are having a medical emergency, call 911.

What an AI assistant can see about you, what is recorded, and how to opt out are described in Section 8 of our Privacy Policy.

9. Email and text messages

If you give us your phone number or email address, you agree that we may contact you about your inquiry, your appointment, and your care at the practice. Some of those calls and messages may be placed by an automated or AI assistant, as described in Section 8.

Where we send messages by text: message frequency varies, message and data rates may apply, and consent is not a condition of purchasing any product or service. You can stop text messages at any time by replying STOP, and get help by replying HELP or by calling the office. Carriers are not liable for delayed or undelivered messages. How we handle the contact information you give us is described in our Privacy Policy.

10. Permitted use of this site

You may use the Site for your own personal, non-commercial purposes. You agree not to:

• use the Site for any unlawful purpose, or in violation of these terms;
• attempt to gain unauthorized access to the Site, its servers, or any related system;
• interfere with or disrupt the Site, including by introducing malware or by overloading or probing it;
• use any automated means — scraper, bot, or harvester — to extract content or contact information from the Site;
• copy, reproduce, republish, or redistribute Site content except as permitted below; or
• submit anything false, misleading, defamatory, harassing, infringing, or that contains another person’s private information without their permission.

We may suspend or terminate access to the Site at any time, without notice, for any reason, including a breach of these terms.

11. Content and intellectual property

The Site and its content — text, graphics, photography, logos, layout, and design — are owned by Brazelia MedSpa & Integrative Wellness or its licensors and are protected by copyright, trademark, and other laws. “Brazelia MedSpa & Integrative Wellness” and our logo are our marks and may not be used without our prior written permission.

You may view, download, and print pages from the Site for your own personal, non-commercial reference, provided you do not remove any copyright or proprietary notice. Any other use — including reproduction, modification, distribution, or republication — requires our prior written consent. Third-party names and marks appearing on the Site belong to their respective owners and do not imply any endorsement or affiliation.

12. Reviews and submissions

If you send us a review, testimonial, comment, photograph, or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it in connection with the practice, and you confirm that it is your own and does not infringe anyone else’s rights. We are not obliged to publish or keep publishing any submission.

We do not use your images or your identifiable health information in marketing without your separate written authorization.

13. Third-party links and services

The Site links to, and uses services operated by, third parties — including our online booking tool, live chat, analytics, and social media platforms. We do not control those services and are not responsible for their content, availability, security, or practices. Your use of a third-party service is governed by that party’s own terms and privacy policy, which we encourage you to read. A link is not an endorsement.

14. Accessibility

We want the Site to be usable by as many people as possible and work to improve accessibility over time. If you have difficulty using any part of the Site, please contact us using the details below and tell us what you encountered — we will do our best to provide the information you need in another format.

15. Disclaimer of warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site is free of harmful components.

This section limits warranties about the website. Nothing in these terms limits or disclaims any duty a licensed healthcare professional owes to a patient under Florida law, and nothing here excludes liability that cannot be excluded by law.

16. Limitation of liability

To the fullest extent permitted by law, Brazelia MedSpa & Integrative Wellness and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of, or inability to use, the Site — whether based in contract, tort, statute, or otherwise, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred US dollars (US$100).

Again, these limits concern the website. They do not apply to, and do not limit, any claim arising from the professional care you receive at the practice.

17. Indemnification

You agree to indemnify and hold harmless Brazelia MedSpa & Integrative Wellness and its owners, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these terms, or your violation of the rights of another.

18. Changes to these terms

We may update these terms from time to time. The current version always appears on this page with its effective date. Changes take effect when posted, and your continued use of the Site after that constitutes acceptance. We encourage you to check this page periodically.

19. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or relating to the Site or these terms will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.

If any provision of these terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it.
